Terms & Conditions
Last updated: June 28, 2024
These Terms & Conditions ("Terms") govern your access to and use of the Oodaan website, platform, recruitment services, and related services ("Services"). By accessing or using Oodaan, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree with these Terms, you must not use the platform or Services.
1. About Oodaan
Oodaan is the public-facing brand of Oodaan Star Service Private Limited. Oodaan is a recruitment lifecycle platform that facilitates access to employment opportunities, including overseas employment opportunities, and supports various stages of the recruitment process. Depending on the applicable opportunity and service, Oodaan may facilitate or coordinate job discovery and applications; candidate screening and assessment; candidate and document verification; recruitment and interview coordination; employment documentation; visa and work-permit assistance; pre-departure and placement coordination; and communication between candidates and relevant employers, recruitment partners, and service providers.
The specific Services available to a candidate may vary depending on the country, employer, position, recruitment arrangement, and applicable legal requirements. Use of the Oodaan platform does not by itself guarantee employment, placement, visa approval, work-permit approval, or successful completion of the recruitment process.
2. Eligibility
To use Oodaan's Services, you must be at least 18 years old, unless otherwise permitted by applicable law; provide accurate and complete information; have a valid passport or be legally eligible to obtain the documents required for the applicable opportunity; meet the qualifications and eligibility requirements of the position for which you apply; and comply with applicable laws and regulations. Certain positions or countries may have additional eligibility requirements.
3. Account Registration
Where an account is required, you agree to provide accurate, complete, and truthful information; keep your information updated; maintain the confidentiality of your login credentials; not share your account with another person; and notify Oodaan promptly if you suspect unauthorized access to your account. You are responsible for activities carried out through your account, except where such responsibility cannot legally be imposed.
4. User Responsibilities
You agree to provide genuine and accurate information; keep your personal, educational, professional, and contact information current; provide genuine and valid documents; attend scheduled interviews, assessments, appointments, and other required activities; complete required documentation within applicable timelines; follow applicable immigration, employment, and other laws; follow instructions provided by Oodaan and relevant authorized parties; and not use Oodaan for fraudulent, unlawful, deceptive, or abusive purposes.
You must not submit forged, altered, misleading, or fraudulent information or documents. Such conduct may result in rejection of an application, suspension of an account, termination of Services, and/or reporting to the appropriate authorities where required.
5. Candidate Fees and Stage-Based Payments
Certain overseas recruitment opportunities offered through Oodaan may involve candidate payments for recruitment-related services and costs associated with the applicable employment process. The total amount, applicable charges, payment schedule, and services or costs included will be communicated to the candidate before the candidate proceeds with the relevant payment stage. Depending on the particular recruitment opportunity, payments may be collected in stages rather than as a single payment.
Stage 1 — Interview and Assessment
Where a position requires a live interview, practical assessment, trade test, technical evaluation, or other candidate assessment, an applicable interview and assessment charge may be payable before the assessment. This charge may cover costs associated with conducting and coordinating the required assessment process. Payment of an interview or assessment charge does not guarantee selection.
Stage 2 — Work-Permit Process
If a candidate is selected following the applicable interview or assessment, the candidate may be required to make the payment applicable to the work-permit and related processing stage. Work-permit approval is determined by the relevant authorities and/or applicable process. Oodaan does not guarantee that a work permit will be approved.
If the required work permit is not approved or the applicable work-permit process cannot proceed, any eligible refund will be processed in accordance with the applicable payment terms communicated to the candidate. Where applicable, amounts already incurred for completed services, including interview, assessment, documentation, processing, or other non-refundable costs, may be deducted from the amount refundable. The applicable refund calculation and exclusions will be communicated to the candidate as part of the relevant recruitment/payment terms.
Stage 3 — Visa and Insurance
Following successful completion of the applicable work-permit stage, further payments may become due for the visa process, required insurance, and other applicable costs or services associated with the candidate's overseas employment process. Visa approval remains subject to the decision of the relevant immigration or government authority. Payment for visa-related services does not guarantee visa approval.
Stage 4 — Final Pre-Departure Payment
Following the required visa approval and completion of the applicable pre-departure requirements, a final payment may become due before departure. The applicable amount and items covered by the final payment will be communicated to the candidate before payment is requested.
Payment Transparency
Before each applicable payment stage, Oodaan will communicate, as applicable, the amount payable, the purpose of the payment, the services or costs covered, the payment deadline, applicable refund conditions, any non-refundable component, and applicable third-party or government costs. Candidates should retain all payment receipts and related documentation.
No Guarantee
Payment of any individual stage or the full applicable recruitment cost does not guarantee employment, final employer selection, work-permit approval, visa approval, immigration clearance, travel authorization, or final placement. These outcomes may depend on employers, government authorities, immigration authorities, document verification, medical requirements, and other circumstances outside Oodaan's control.
Authorized Payments
Candidates should make payments only through payment methods and accounts officially communicated by Oodaan. Oodaan is not responsible for payments made to unauthorized persons or accounts. If someone claiming to represent Oodaan requests a payment that differs from the official payment instructions or appears suspicious, candidates should contact Oodaan through its official communication channels before making the payment.
6. Job Listings
Oodaan may publish job opportunities based on information provided by employers, recruitment partners, or other authorized sources. Job information may include position, location, qualifications, experience, salary or compensation information, employment conditions, requirements, and application requirements.
Job availability and requirements may change. Oodaan may update, suspend, or remove a job listing when necessary. A job listing does not guarantee that the position will remain available or that an applicant will be selected.
7. Job Applications
Submitting an application does not guarantee an interview, selection, employment, visa approval, work-permit approval, or placement. Candidates may apply for opportunities for which they meet the stated requirements. Applications may be evaluated based on qualifications, experience, documentation, interview performance, employer requirements, availability, and other relevant criteria. The final hiring decision rests with the applicable employer or hiring party.
8. Candidate Verification and Documents
Candidates may be required to provide documents including, where applicable, passport, identification documents, educational certificates, professional certificates, experience documents, employment records, medical documents, police or other legally required certificates, and other documents required for the applicable recruitment process.
You represent that documents and information provided by you are genuine, accurate, and valid. Oodaan may verify information or documents where reasonably necessary for recruitment, compliance, fraud prevention, or legal requirements. Providing false, forged, altered, or misleading documents may result in immediate disqualification or termination of your access to the Services.
9. Resume and Document Processing
Where Oodaan provides resume or document-processing functionality, information may be extracted or processed for recruitment and application purposes. The handling of personal information and documents is governed separately by Oodaan's Privacy Policy and applicable data-protection requirements.
10. Visa and Work-Permit Assistance
Where applicable, Oodaan may facilitate or coordinate visa and work-permit related processes. Visa and work-permit decisions are made by the relevant government or immigration authorities. Oodaan does not guarantee visa approval, work-permit approval, immigration clearance, processing time, entry permission, or residence permission.
Candidates must provide required information, documents, and cooperation and must comply with the requirements of the relevant authorities. Applicable visa, work-permit, government, medical, documentation, travel, insurance, and other third-party costs will be communicated according to the particular recruitment arrangement.
11. Employment Relationship
Unless expressly stated otherwise in a separate written agreement, Oodaan is not the employer of a candidate merely because the candidate uses the platform or receives recruitment assistance. The employment relationship, where established, is between the candidate and the relevant employer. Employment terms may include salary, working hours, benefits, leave, accommodation, contract duration, working conditions, and other employment terms.
The applicable employment contract and laws of the employment jurisdiction govern the employment relationship. Candidates should carefully review and understand their employment contract before accepting an offer.
12. No Guarantee of Placement
Oodaan facilitates recruitment and related processes but does not guarantee successful placement. Placement may depend on factors including employer selection, candidate qualifications, interview performance, document verification, job availability, immigration requirements, government decisions, medical requirements, employer decisions, and other circumstances beyond Oodaan's reasonable control.
13. Third-Party Services and Partners
Oodaan may work with employers, recruitment partners, service providers, government authorities, visa-processing providers, insurance providers, and other third parties. Certain Services may therefore be subject to third-party terms, requirements, charges, processing times, and decisions. Oodaan does not control decisions made independently by government authorities, employers, immigration authorities, or other third parties.
14. Intellectual Property
The Oodaan platform and its original content, including its name, logo, branding, text, graphics, software, interface, website content, and other original materials, are owned by Oodaan or its applicable licensors and may be protected by intellectual-property laws. You may use the platform for its intended purpose. You may not reproduce, copy, modify, distribute, sell, commercially exploit, reverse engineer, or otherwise use protected Oodaan content without appropriate authorization, except where permitted by law.
15. Prohibited Activities
You must not use Oodaan for unlawful purposes; submit fraudulent documents; create fraudulent accounts; impersonate another person or organization; provide misleading information; attempt to access another user's account; circumvent security controls; introduce malicious code or software; interfere with the operation of the platform; scrape or systematically collect platform information without authorization; or use the platform to defraud candidates, employers, Oodaan, or other parties.
16. Account Suspension and Termination
Oodaan may suspend, restrict, or terminate access to an account or Services where reasonably necessary, including where these Terms are violated; fraudulent activity is suspected; false or misleading information has been submitted; security or abuse concerns arise; or access must be restricted to comply with applicable law. Where required by law, applicable notice and procedural requirements will be followed. Termination does not affect rights or obligations that accrued before termination.
17. Platform Availability
Oodaan aims to maintain a reliable platform but does not guarantee that the platform will always be uninterrupted, error-free, or continuously available. The platform may become temporarily unavailable because of maintenance, updates, technical failures, security incidents, infrastructure failures, third-party service interruptions, or events outside Oodaan's reasonable control.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Oodaan will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or relating to the use of the platform or Services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Oodaan does not accept responsibility for decisions made independently by employers, immigration authorities, government authorities, visa-processing authorities, or other third parties, except to the extent required by applicable law.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Oodaan and its authorized representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these Terms, your unlawful use of the platform, fraudulent or misleading information submitted by you, or your infringement of another person's rights. This provision does not exclude liability that cannot legally be excluded.
20. Privacy
Your use of Oodaan is also subject to our Privacy Policy. The Privacy Policy separately explains how Oodaan collects, uses, stores, and otherwise processes personal information.
21. Governing Law
These Terms are governed by the laws of India, subject to any mandatory rights or protections applicable to you under applicable law. Any dispute arising from these Terms or your use of Oodaan shall be subject to the jurisdiction of the courts having appropriate jurisdiction under applicable law.
22. Changes to These Terms
Oodaan may update these Terms from time to time. Where material changes are made, Oodaan may provide notice through the platform or another appropriate communication method. The updated Terms will contain a revised "Last Updated" date. Continued use of Oodaan after the updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
24. Entire Agreement
These Terms, together with any additional terms applicable to particular Services, constitute the terms governing your use of Oodaan unless a separate written agreement expressly applies.
